The problem with the FDCPA is that the btuony on violating it is very low/it has a very weak penalty. The last time I looked at the statutes, it was something like a grand if you find that someone violates it.That is per case NOT per incident. So say that a debt collector calls you every 10 minutes, threatens you, etc. The most you can get is 1000 bucks plus attorneys fees. It's also up to the person in debt to largely do the enforcement of filing a complaint, etc. which creates a huge barrier to actual enforcement.So in practical respects, if you've got a student/target who is has over $100,000 dollars or more in debt, does it really matter if you lose out a thousand bucks maybe 1 or 2 more grand on top in attorney's fees to eventually get the payoff?My guess would be no.

Apparently she is supposed to be an international Lawyer with appauling grammar and her daughter is due to start at the Uni of Portsmouth.
